Telangana HC Seeks SOP From DGP to Ensure Timely Enforcement of Police Protection Orders

The Telangana High Court has asked the DGP to consider an SOP to ensure timely enforcement of lower-court orders directing police protection.

Hyderabad: The Telangana High Court has directed the state Director General of Police (DGP) C.V. Anand, a 1991-batch IPS officer of the Telangana cadre, to examine delays in enforcing police-protection orders issued by subordinate courts and consider putting in place a Standard Operating Procedure (SOP) for timely assistance.

A division bench comprising Chief Justice Aparesh Kumar Singh and Justice G M Mohiuddin expressed concern over litigants being compelled to approach the High Court to secure implementation of orders already passed by lower courts. The bench observed that such delays were adding to the burden on the judiciary and contributing to avoidable litigation.

Land Dispute Brings Issue Before High Court

The issue arose during the hearing of an appeal filed by Peesari Gopaiah, a farmer from Yadadri-Bhongir district, in a dispute concerning the fencing of land.

The matter involved Nalla Venkat Reddy, who had obtained an order from a lower court in November 2025 directing the police to provide protection while he carried out fencing work. Reddy later approached the High Court alleging that the police had not acted on the order.

A single judge subsequently directed the police to provide protection whenever Reddy sought to undertake the fencing work. Gopaiah challenged that direction before the division bench, alleging that the police protection was being used to threaten him and interfere with his possession of the property.

Reddy, however, maintained that police assistance was necessary to implement the lower court’s order and reconstruct a damaged boundary wall.

Court Seeks District-Level Mechanism

The division bench noted that similar difficulties appeared to be affecting people in different parts of Telangana when lower-court orders requiring police assistance were not implemented promptly.

The court’s directions focused on:

  • Examining systemic delays in enforcing police-protection orders.
  • Considering an SOP for timely police assistance.
  • Developing a mechanism at the district level to handle complaints regarding non-compliance.
  • Improving coordination between the police and authorities dealing with court orders.

The bench asked the government pleader for Home to discuss the issue with the DGP and work out an appropriate system.

Police Protection Limited to Lower Court Order

Pending further proceedings, the High Court directed that police protection in the case should be provided strictly in accordance with the lower court’s order.

The matter has been posted for further hearing on September 23.

The court’s intervention places the focus on ensuring that judicial directions requiring police assistance are implemented through a clear and consistent procedure, without forcing litigants to repeatedly seek intervention from higher courts.
