Why Haryana IAS Officer Challenged FIR in High Court: Full Story of HSVP Case and Section 17A Dispute

Chandigarh: The IAS officer D. Suresh FIR challenge has reached the Punjab and Haryana High Court, where senior IAS officer D. Suresh has questioned the legality of an FIR registered against him in a corruption case. The matter is linked to alleged financial loss involving the Haryana Shahari Vikas Pradhikaran. 

The officer claims that due legal procedures were not followed before granting sanction for the FIR. The case raises important questions about administrative accountability and legal safeguards under anti-corruption laws.

Background of the IAS Officer D. Suresh FIR Challenge Case

The issue dates back to November 2019, when the Haryana Vigilance Bureau started an inquiry.

  • The case involves plot number 4377 in Gurgaon Sector-23, allotted for a school.
  • At that time, D. Suresh was serving as Chief Administrator of HSVP in Panchkula.
  • The inquiry included multiple officials and private individuals.

Earlier, the District Consumer Forum ruled in favour of the allottees. However, this decision was later reversed by the State Consumer Forum, which added complexity to the case.

Why the IAS Officer Approached the High Court

D. Suresh, a 1995-batch IAS officer currently posted as Principal Resident Commissioner at Haryana Bhawan, New Delhi, has challenged:

  • A February 2 order allowing FIR registration
  • Charges under:
    • Criminal conspiracy
    • Criminal breach of trust
    • Cheating
    • Sections of the Prevention of Corruption Act, 1988

He has requested the court to quash the sanction for the FIR, arguing that it is legally flawed.

Key Legal Argument: Section 17A

The main argument in the Haryana IAS officer FIR challenge is based on Section 17A of the Prevention of Corruption Act.

  • This section requires prior approval before investigating public servants for decisions taken in official duty.
  • Suresh claims:
    • The November 25, 2019 inquiry did not follow this rule.
    • Proper procedure was not followed before granting FIR sanction.
    • Separate sanction should have been taken if multiple officers were involved.

He also informed the court that he has already filed a separate petition challenging the inquiry report, which is still pending.

IAS Officer D. Suresh FIR Challenge: Government’s Response in Court

When the case came up before Justice Jagmohan Bansal, the Haryana government:

  • Requested more time to respond
  • Did not immediately counter the officer’s legal claims

The matter is currently pending before the High Court.

Who is IAS Officer D. Suresh

D. Suresh is a 1995-batch IAS officer of the Haryana cadre with over three decades of experience in public administration. Born on August 12, 1966, in Andhra Pradesh, he holds a Master’s degree in Business Administration (MBA). Throughout his career, he has earned a reputation for managing complex departments ranging from urban development to education. 

He is currently serving as the Principal Secretary to the Government of Haryana, Fisheries Department, a role he assumed in early 2024.

​A significant portion of D. Suresh’s career has been defined by his leadership in urban infrastructure and administrative reform. He previously served as the Chief Administrator of the Haryana Sahari Vikas Pradhikaran (HSVP) and the Commissioner of the Gurugram Division. 

Notably, he has also held the post of Member Secretary of the Haryana Governance Reforms Authority, where he was tasked with streamlining government processes to improve transparency and public service delivery across the state.

​3. Strategic Leadership Across Diverse Portfolios

​Known for his versatility, D. Suresh has navigated a wide array of high-stakes assignments. His resume includes stints as the Principal Secretary for Art & Cultural Affairs and Housing for All. He has also served in central deputation roles, including Director (Estates) in the Union Ministry of Urban Development. 

His extensive experience in both district-level administration (serving as Deputy Commissioner in districts like Sirsa) and state-level policy-making has made him a key figure in the Haryana bureaucratic machinery.
