No Age Relaxation for EWS Category: Delhi High Court Upholds Current Recruitment Rules

New Delhi: The Delhi High Court age relaxation EWS candidates case has drawn significant attention after the court dismissed a petition seeking additional age relaxation for candidates under the Economically Weaker Sections (EWS) category in government job recruitments.

The decision clarifies the legal position on reservations and age benefits, reinforcing that EWS candidates cannot claim the same relaxations granted to other reserved categories like SC, ST, and OBC.

The petition was filed by candidates who argued that EWS category applicants should also receive age relaxation benefits similar to other reserved categories in government recruitment processes.

They claimed that denying such relaxation puts EWS candidates at a disadvantage, especially in competitive exams where age limits play a crucial role. However, the court examined the constitutional and legal framework governing EWS reservations before delivering its verdict.

Supreme Court Directives on EWS Age Relaxation Rule 

The court clearly stated that:

  • The EWS category was introduced as a separate reservation class under the Constitution.
  • It is distinct from socially and educationally backward classes such as SC, ST, and OBC.
  • Age relaxation is not a mandatory benefit under EWS reservation.

The court emphasized that government policies providing age relaxation to certain categories are based on historical and social disadvantages, which do not apply in the same way to EWS candidates.

Legal Reasoning Behind the Decision

The court relied on constitutional provisions, particularly those introduced through the 103rd Constitutional Amendment, which created the EWS category.
