Commercial Court Rules 2021 Stuck: Supreme Court Questions Centre, Pushes for Reform

The Supreme Court questioned the Centre over the delay in notifying the Commercial Court Rules 2021 and suggested High Courts may set up District Execution Cells for faster disposal of execution petitions.

New Delhi: The Commercial Court Rules 2021 issue came under sharp focus after the Supreme Court questioned the Union Government over the delay in notifying the draft rules. 

The Court said India is facing a major challenge in the fast disposal of execution petitions in commercial disputes. The matter was heard by a bench of Justice JB Pardiwala and Pankaj Mithal.

Details of Commercial Court Rules 2021 Case

The Supreme Court took suo motu notice of the delay in notifying the draft Commercial Courts Rules, 2021.

According to the Court:

  • Commercial dispute execution cases are facing long delays.
  • Lack of uniform rules is affecting speedy justice.
  • Effective implementation is needed at the district level.

The bench observed that High Courts may think about creating special “District Execution Cells” for better handling of execution petitions.

Why Is Commercial Court Important?

Commercial courts handle:

  • Business disputes
  • Contract enforcement
  • Arbitration-related matters
  • Corporate recovery cases

Fast disposal is important because delays can:

  • Hurt business confidence
  • Increase litigation costs
  • Slow economic activity
  • Affect ease of doing business in India

The Supreme Court noted that execution of decrees remains one of the biggest weaknesses in the judicial system.

What Are District Execution Cells?

The Court suggested that High Courts may consider:

  • Dedicated district-level execution departments
  • Special monitoring systems
  • Faster decree implementation mechanisms
  • Better tracking of pending execution matters

These cells could help courts ensure judgments are actually implemented quickly.

Commercial Court Rules 2021: Supreme Court’s Concern

The bench highlighted that merely passing judgments is not enough if decrees are not executed on time.

The Court reportedly described the issue as a “huge challenge” for the country’s judicial system.

Background of Commercial Courts Rules 2021

The draft Commercial Courts Rules, 2021 were proposed to:

  • Standardize procedures across courts
  • Improve efficiency in commercial litigation
  • Reduce delays in execution proceedings
  • Strengthen business dispute resolution

However, the rules are yet to be officially notified by the Centre.
