Ladakh: J&K High Court has ruled that the appointment of four civil judges in 2011 was illegal because of a clerical mistake made during the recruitment process. The Court said the error started with an incorrect advertisement issued by the then Jammu and Kashmir Law Department and the J&K Public Service Commission (PSC). The judgment explains how the mistake affected the selection process and why the appointments could not be treated as valid.
J&K High Court Recruitment Case: What Did the High Court Directed
The Jammu & Kashmir and Ladakh High Court examined the recruitment process for Civil Judges (Munsiffs) conducted in 2011. The Court found that four candidates were appointed based on future vacancies that were wrongly included because of a clerical mistake in the recruitment advertisement.

According to the Court, appointments made through a recruitment process must strictly follow the number of vacancies officially notified. Any appointment beyond those notified is not legally valid unless permitted by law.

The controversy began when the State Law Department and the Jammu & Kashmir Public Service Commission issued a recruitment advertisement. The advertisement reportedly included vacancies that were not actually available at the time of recruitment.
As a result, four additional candidates were selected and later appointed as Civil Judges even though those posts were future vacancies and had not been officially advertised in accordance with the rules.
Court’s Key Observation
The High Court observed that public recruitment must remain transparent and fair. It said government authorities cannot fill posts beyond the vacancies mentioned in the official recruitment notification because doing so violates the principles of equal opportunity for all eligible candidates.
The Court described these appointments as “illegal” because they were based on an incorrect recruitment process rather than on the eligibility of the selected candidates.
