New Delhi: The supreme court has reaffirmed that Railway Protection Force (RPF) employees who deliberately hide pending criminal cases during recruitment can be discharged from service at any stage. In a significant ruling, the Supreme Court upheld the discharge of several RPF and RPSF constables who failed to disclose criminal proceedings against them while applying for government jobs. The judgment highlights the importance of honesty, transparency, and integrity in public service recruitment.

RPF Rules: Supreme Court Upholds Discharge Of RPF Constables

The case involved a group of candidates recruited as constables in the Railway Protection Force (RPF) and Railway Protection Special Force (RPSF). The candidates successfully cleared the written examination, physical efficiency test, and medical examination.

They were also included in the final selection list. However, during the recruitment process, they allegedly failed to disclose that criminal cases were pending against them. 

The authorities later discovered the undisclosed cases while the candidates were undergoing training. As a result, they were discharged from service between June and October 2015.

RPF Rules: What Did The Supreme Court Say

A Bench of Justice Pamidighantam Sri Narasimha and Justice Alok Aradhe observed that recruitment rules clearly require candidates to provide complete and truthful information.

The Court stated that a candidate participating in a government recruitment process must disclose all relevant facts, including any pending criminal case.

According to the Court, if a candidate deliberately suppresses such information, the employer can take action, including discharge from service.

Why Did The Court Reject The Appeal

The Supreme Court noted that the candidates were aware of the criminal proceedings but still chose not to mention them in their verification forms.

The Court relied heavily on its landmark judgment in Avtar Singh v. Union of India (2016), which established principles governing suppression of criminal antecedents in public employment.

The judges observed that deliberately hiding multiple pending criminal cases directly affects a candidate’s credibility and suitability for public service positions. Because of this, the Court found no reason to interfere with the decisions of the authorities or the Allahabad High Court.

What Are The RPF Rules Regarding Criminal Cases

Under the Railway Protection Force recruitment rules, candidates must disclose:

Pending Criminal Cases

Any ongoing criminal investigation or court case must be declared.

Past Convictions

Candidates must provide details of previous convictions, if any.

Other Relevant Criminal Proceedings

Any criminal matter that could affect eligibility must be disclosed during verification.

Failure to provide accurate information can lead to cancellation of candidature, discharge from service, or termination of employment.

Court Relies On Landmark Avtar Singh Judgment

The Supreme Court referred to the landmark Avtar Singh v. Union of India (2016) judgment. That ruling established that when a candidate deliberately suppresses information about criminal cases, employers have the authority to cancel candidature or terminate employment after considering the facts of the case.

The Court observed that the present case squarely falls within the principles laid down in Avtar Singh because the candidates consciously chose not to disclose the criminal proceedings against them.

Why Public Service Jobs Require Full Disclosure

The Supreme Court emphasized that public service organizations such as the RPF are responsible for maintaining law and order and protecting public property. For such positions, character, integrity, and trustworthiness are extremely important.

The Court noted that when candidates conceal important information, it raises concerns about their honesty and suitability for service.

RPF Rules: What About Candidates Who Are Later Acquitted

One of the arguments raised before the Court was that some candidates were later acquitted. However, the Court held that the main issue was not the final outcome of the criminal cases but the fact that the candidates failed to disclose the cases when required. The judges distinguished earlier cases where courts had granted relief because the facts and circumstances were different.

Difference Between Deliberate Hiding And Genuine Lack Of Knowledge

The Supreme Court has clarified in separate judgments that deliberate suppression and genuine lack of knowledge are different situations. If a candidate genuinely did not know about a criminal case, the matter must be examined carefully. However, where a person knowingly hides criminal proceedings, authorities can take strict action under service rules.
