Woman Coast Guard Officer Priya Tyagi Permanent Commission Case: Supreme Court Strengthens Women’s Rights In Uniformed Services 

The Supreme Court has urged the Centre to grant Permanent Commission to Indian Coast Guard officer Priya Tyagi, stressing that deserving women officers should not face discrimination or humiliation in service.

New Delhi: The Supreme Court has strongly urged the Central Government and the Indian Coast Guard to grant Permanent Commission (PC) to Coast Guard officer Priya Tyagi. 

The Court observed that a deserving woman officer should not face humiliation and indicated that it may issue formal directions if the government fails to act. The case is being closely watched as it relates to gender equality and career opportunities for women in uniformed services.

A Bench led by Chief Justice of India Surya Kant, along with Justice Joymalya Bagchi and Justice V. Mohana, heard the matter concerning Priya Tyagi, a Short Service Appointment officer in the Indian Coast Guard.

During the hearing, the Court questioned why women officers should be denied Permanent Commission when similar opportunities are available to male officers. The Bench stated that women officers cannot be excluded merely because a formal policy was not created for them.

The Court also remarked that it would not allow a capable officer to be humiliated and asked the authorities to show fairness in dealing with the case.

Who Is Priya Tyagi

Priya Tyagi joined the Indian Coast Guard as an Assistant Commandant in 2009. Over the years, she earned promotions and served in various roles. She later sought Permanent Commission and received recommendations from her superior officers.

According to submissions made before the Court, Tyagi has around 4,500 flying hours and significant operational experience. Her legal team argued that her performance record supports her claim for Permanent Commission.

Why Did The Priya Tyagi Permanent Commission Case Reach The Supreme Court

The dispute began after Priya Tyagi was not granted Permanent Commission and was eventually released from service. She challenged the decision before the Delhi High Court. Later, the Supreme Court took up the matter and allowed her to continue serving through an interim order while the case remained pending. The Court was informed that the Coast Guard earlier did not have a policy for granting Permanent Commission to women officers in similar positions.

Centre’s Stand Before The Court

The Attorney General informed the Court that the Indian Coast Guard operates under different conditions compared to the Indian Navy.

The government argued that infrastructure limitations and operational requirements affected the availability of Permanent Commission opportunities. It also stated that the case would be examined to see whether Tyagi could be accommodated. However, the Supreme Court was not fully convinced by these explanations and stressed the need for equal treatment.

The Bench emphasized that administrative difficulties cannot become a reason to deny women equal opportunities. The judges observed that if a system exists for male officers, women officers should not be excluded from its benefits. The Court viewed the issue through the lens of fairness and constitutional equality.
